Unfortunately, last week, a man driving his moped in Boynton Beach was struck by a woman driving too closely behind him. When the woman’s vehicle hit the man’s moped, he lost control of the moped and fell off, striking his head twice suffering a serious head injury and putting him into a coma. He also suffered multiple fractures and remains in the intensive care unit at the hospital.

As we know, in the State of Florida, when a driver is involved in a crash involving serious bodily injury, that driver has a legal duty to remain at the scene of the crash until they’ve fulfilled certain requirements (provide applicable information to relevant parties, request or supply medical and/or other aid as is necessary, etc.). If the person fails to meet such requirements, as stipulated by state law, they can be charged with a third-degree felony, punishable by up to $5,000 in fines and/or 5 years in prison. Clearly, leaving the scene of an accident causing serious bodily injury is a serious crime with serious consequences.
That said, as our Delray Beach personal injury lawyers know, just because someone has violated a law and must thus face the consequences as seen fit by the State of Florida, that person also is responsible for paying for any damages associated with injuries they’ve inflicted on others, as the woman did in this case. Because of the Lantana woman’s reckless driving, the man on the moped suffered injuries sufficient to warrant his admission to Delray Medical Center, where he remained on life support the day after the accident.
As has been reported, a witness to the crash (someone who was in the car with the woman when the crash took place) told police that the woman became upset by how slow the man on the moped was traveling. As the two were traveling on West Gateway Boulevard near Quantum Boulevard, the woman got close to the moped, practically tapping its back wheel to force the moped to speed up. The driver of the moped yelled at the woman, telling her to back off, but she just kept getting closer.
After she struck the moped and caused the man to lose control of his moped and fall off, as our Delray Beach personal injury lawyers have learned from the witness, despite being told by witnesses to the crash that she needed to return to the scene of the crash and provide assistance, the woman just hopped on I-95 and fled the scene. Police caught up with the woman later in the day and arrested her, taking her to Palm Beach County Jail; her bail was set at $20,000.
