How to choose the best Delray Beach auto accident lawyer?

First, make sure your car accident lawyer specializes in auto accidents and personal injuries. Second, find out whether the auto accident attorney has successfully handled a case like yours in the past and whether they are able to take your case to trial if necessary. It is also important to know who your main point of contact at the firm will be. At Aronberg & Aronberg, Injury Law Firm, we feel strongly that direct access to your attorney is very important.

Do I have a car accident case?

Auto accidents occur daily in Delray Beach and the surrounding area. These accidents range in severity from a mere inconvenience to a life-changing event. In determining whether an experienced motor vehicle accident lawyer will be successful in winning money for your auto accident case there are three key factors to consider which include: (1) FAULT , (2) INJURIES, and (3) INSURANCE.

(1) Who was at FAULT for the accident?

The first step in obtaining compensation as a result of an auto accident is to prove that some other party is entirely, or even partially, at FAULT for the accident. An experienced injury lawyer will assess the crash site, analyze the property damage, download the vehicle’s electronic data recorder, and obtain witness statements to help figure out who was at fault for the car crash. Whether the police assigned fault at the accident site is not a crucial factor and your auto accident attorney should do their own investigation.

(2) Severity of INJURIES sustained

The amount of compensation a car accident victim deserves is directly related to the nature of the INJURIES. People who have minor and non-permanent injuries are only entitled to compensation for medical bills and lost wages. If an injured party obtains medical evidence that their injury is permanent, they will be entitled to greater damages including past and future pain and suffering.

(3) Securing INSURANCE coverage

Injury lawyers usually fight insurance companies and big corporations. Going after low- or middle-income defendants are usually not productive in obtaining money for the injured party. For this reason, it is important to find an INSURANCE policy that applies to your car accident.

What to Do After an Accident

Stay at the Scene

If you are involved in an accident involving injury, or substantial damage to property, stay at the accident scene until the police tell you that you can leave.

Get to a Safe Place & Call 911

Get to a safe place but use common sense whether an injured person should be moved. Have someone call the police. If you are on the roadway, turn your flashers on to warn approaching traffic of the accident.

Do Not Admit Fault

Even if you think you are at fault, do not admit liability. There may be factors that you do not know, which played a role in the accident, and it may turn out that the other driver was more at fault than you. Besides the police, do not make statements to anybody at the accident scene. When you speak to the police, tell them only the facts of what happened. Let the officers draw their own conclusion from the facts.

Document the Scene

Take photographs and videos of the accident scene, the vehicles’ damages, the people involved in the accident, license plates and drivers’ licenses.

Witness Information

Get the name and contact information for all witnesses.

Video Surveillance

Make note of any video cameras that may have captured the crash. You or your Delray Beach attorney should obtain and preserve video footage of the auto collision as soon as possible.

Preserve All-Vehicle

There may be important information contained within the vehicles’ black box (electronic data recorder) that may assist in winning your case. Do not sell or total your vehicle before speaking with your lawyer.

Get Medical Care

Insurance companies evaluate cases based upon the type of medical care that you receive. Insurance companies also place great emphasis on how soon after the accident the injured party sought medical treatment.

What does auto insurance cover?

Our attorneys know the term “full coverage” is misleading and often leaves Delray Beach car accident victims underinsured. Below is a list of mandatory coverages that are available on every insurance policy:

Personal Injury Protection (“PIP”)

This covers 80% of medical bills up to $10,000.00 for injuries you or a family member may incur in the event of a motor vehicle accident regardless of whose vehicle you are in, even if you are injured as a passenger in someone else’s vehicle, as a pedestrian or on a bicycle, and regardless of who is at fault for the accident. Injuries sustained on a motorcycle are not covered under PIP. This protection also covers passengers in your automobile who do not own a vehicle and do not carry automobile insurance. To qualify for PIP benefits, you must seek medical treatment within the first 14 days following the car accident.

Property Damage Insurance

This covers damage to another driver’s vehicle in the event you are at fault for an accident. It does not cover your vehicle. State law requires $10,000 of property damage insurance.

Below is a list of optional coverages that may apply to your case depending on the coverages you and the adverse driver purchased:

Collision Insurance

This covers damage to your own vehicle in the event of a motor vehicle accident, regardless of fault.

Comprehensive Insurance

This covers damage to your vehicle for events not caused by a motor vehicle accident, such as natural disasters, storms, vandalism, fire, and theft.

Bodily Injury Liability Insurance

This covers damages to another person (note it will not cover damages you sustained) if you are found to be at fault for a motor vehicle accident. Of course, their own PIP coverage will pay for the first $10,000.00 in medical bills; however, medical bills often exceed $10,000.00. Bodily Injury Liability coverage compensates the injured person for permanent loss, future medical expenses, wage loss, personal loss and pain, and suffering. It is important to know that the State of Florida does not require drivers to purchase Bodily Injury Liability insurance. It is possible that someone who causes injuries to others in a motor vehicle accident may not carry Bodily Injury Liability Insurance.

Uninsured/Underinsured Motorist Insurance (“UM”)

This covers you, your family members and your passengers in the event the person who causes your injuries does not carry enough Bodily Injury Liability insurance. This coverage enables you to bring a claim against your own policy which will stand in the place of the uninsured or underinsured driver. We strongly recommend that you protect yourself, your family, and your passengers by purchasing this coverage.
