As personal injury lawyers, we often come under fire from tort reform advocates who call us derogatory terms such as “ambulance chasers,” implying that we are an overly-officious group of attorneys who will file lawsuits at the drop of a hat. We’ve got thick skin and we know the truth paints quite a different picture. The main problem with these baseless insults is that they marginalize the suffering of our clients, the victims of situations that have caused pain and misery in addition to a host of other damages. Society has come to realize that you shouldn’t have to suffer unnecessarily, especially if your suffering is the result of someone else’s (or some company’s) wrongdoing.
That said, there is no doubt that lawsuits are sometimes filed in instances in which they are unwarranted. Take the case of Sirgiorgio Clardy of Portland, Oregon. For the record, filing a baseless lawsuit is hardly the worst thing he’s done recently. This former pimp was recently sentenced to 100 years in prison for beating a prostitute and a john – the prostitute bled from her ears and the john whom he beat required stitches and surgery. In attacking the john, Clardy used one of his Nike sneakers, which was classified as “a dangerous weapon” in Clardy’s most recent trial (he’s got a record of various felonies and misdemeanors).
Now, unhappy with the consequences that he is facing for his savage attacks on others, Clardy is pointing the finger at someone else – or, rather, at something else. From jail, Clardy is suing Nike for $100 million due to the fact that, according to Clardy, Nike failed to warn or consumers about the risk associated with their sneakers, in particular that they are “potentially dangerous.” The ridiculous lawsuit, which, according to NBC News, has yet to be served to the company, is an example of unwarranted litigation, the type of which clogs our judicial system and gets in the way or true victims obtaining true justice.
It is important to remember that the existence of this type of ridiculous lawsuit does not negate the fact that there are countless individuals who incur injuries due to the wrongdoing of others; these individuals have the right to fight for what has been taken from them in a court of law. As personal injury lawyers, we represent individuals who have been injured in car accidents, slip and falls, or medical malpractice incidents, etc. We aggressively advocate on behalf of our clients to make sure that they obtain the compensation they deserve.
