Dispelling Some Personal Injury Myths

Dispelling Some Personal Injury Myths

There is arguably no field of law so burdened by misconceptions and untruths as personal injury law, practiced by attorneys – such as our lawyers at the Law Offices of Aronberg & Aronberg – who represent individuals who have sustained injuries due to the recklessness and/or negligence of others. Therefore, today, we’d like to take the time to address just a few of the more frequent and false remarks leveled at our field of law; these flawed notions often times fuel lies regarding the specifics of personal injury cases and thereby undermine the likelihood of victims being able to obtain compensation for their injuries.

Claim #1: You don’t need a personal injury lawyer. All you have to do is contact the insurance company.

This is probably the most frequent and damaging notion that our personal injury lawyers encounter. Many times, injured individuals will tell us that they heard from “someone” that if they’ve been injured in an accident, all they need to do is contact the insurance company because, after all, “that’s what insurance is for.” On the surface, the logic seems sound, and in a world where insurance companies were all not-for-profit companies devoted solely to the common good, that idea might hold water.

The truth is that insurance companies have one goal: to make money. They are not beholden to their possible beliefs that you should be compensated; they are beholden to their shareholders and their board of directors, who expect to see a growth in profits. How is it that these insurance corporations yield profits? By holding onto the money that they bring in. They do not measure a year’s financial success by how much money they handed out to and on behalf of policyholders; they measure a year’s success by how much money they brought in and how much of it they got to keep (i.e. how much money they did not have to pay out).

If you try to deal with the insurance companies yourself, without a lawyer, you’ll likely fall prey to the many strategies that they employ in order to take advantage of vulnerable victims. However, enlisting an attorney who knows the law, knows what you’re entitled to, and knows how to handle the insurance companies, can result in your obtaining the compensation that you deserve.

Claim #2: You have to invest significant time, energy and money to appear in court in order to obtain compensation for your injuries.

Many victims of personal injury accidents (including car crashes, medical malpractice incidents, slip and falls, etc.) are reluctant to pursue a personal injury claim because of the further stress they believe it will add to their life. These people have already been through a horrible accident – why would they want to commit to having to go to court and sit through a trial in order to obtain compensation? The fact is that personal injury cases such as the ones that we handle all the timerarely go to trial.

One of the premier benefits of retaining an experienced personal injury law firm such as ours is that our attorneys have handled hundreds and hundreds of cases and, almost assuredly, we’ve handled a case just like yours. Because of this, we know how to navigate these cases; we know what strategies work and we know how the people on the other side of the case operate. Given this, we frequently reach a settlement before a case goes to trial. If, in fact, the case does go to trial, you still don’t have to pay a dime unless and until we win the case for you.

Claim #3: It will take years for you to receive compensation.

Let’s preface this by saying that all cases are different and that there are never any guarantees one exactly how long a personal injury case will take to be resolved. Cases that involve larger prospective settlements typically take a bit longer than those that seek to obtain a less substantial sum of money. Nevertheless, most personal injury cases are wrapped-up within a year. As soon as our law firm receives the check from the opposing side, we send you your money. Even though roughly 10 months might seem like a long time, the fact is that you can by and large put the case out of your head and focus on your recovery. Our lawyers will handle the specifics of the case, although we will of course keep you informed of any and all developments.
